David’s stay is a win for SA

Dignity Party MLC Kelly Vincent is pleased that David Lee has been granted permanent residency status.

“Being told that you are not welcome to stay in Australia because you have a disability is unacceptable, and breaches the United Nations Convention on Rights of People with Disability (UNCRPD),” says Kelly Vincent.

“It is becoming commonplace for people who are threatened with losing their residency status to seek last-minute online support, as Mr Lee did, through change.org.

“But we need strong policy that acknowledges the rights of people with disabilities to stay in Australia, without eleventh hour social media driven reviews of decisions.

“In 2010, the joint Federal Parliamentary Committee on Migration found the Migration Act 1958 was discriminatory and urgently needed to be amended.

“Yet here we are in 2017 with migration rules that continue to specifically allow prejudicial treatment against people with disabilities or health conditions, contravening Article 5 of the UNCRPD.

“It’s been great to meet David and to find out about the wonderful ways he’s contributing to our community.  I’m pleased to have assisted in a small way to his being offered a residency visa,” said Ms Vincent.

UNCRPD Article 5 – Equality and non-discrimination:

  1. States Parties recognize that all persons are equal before and under the law and are entitled without any discrimination to the equal protection and equal benefit of the law.
  2. States Parties shall prohibit all discrimination on the basis of disability and guarantee to persons with disabilities equal and effective legal protection against discrimination on all grounds.
